When it's Your Life, Don't Settle

In Ontario, motor vehicle accidents are a leading cause of spinal cord injuries (SCIs). These injuries often result in life-altering consequences, including chronic pain, paralysis, and significant financial burdens due to medical expenses and lost income. Currently, there is no cure for SCIs, making prevention and effective post-injury management crucial.

According to available data, approximately 900 Canadians sustain severe spinal cord injuries each year, with car accidents being the primary cause, accounting for about 35% of these cases.

Given the profound impact of SCIs, it’s essential for victims and their families to seek appropriate medical care and legal advice to navigate the challenges that follow such injuries.

Understanding the Severity of Spinal Cord Injury

The spinal cord is a long stem of nervous tissue that runs down from your brain through the neck and down the back along to the bottom of the lumbar spine. Along with the brain, the spinal cord is an essential part of the body’s central nervous system.

Injuries to the spinal cord may have profound effects on movement and functionality.

Types of Spinal Cord injuries

Complete Spinal Cord Injuries

A complete spinal cord injury results in paralysis below the site of the injury. There is no feeling or voluntary movement and both sides of the body are affected equally. In other words, sensory and motor function is completely lost below the point of the injury.

Quadriplegia (Tetraplegia)

Quadriplegia, or tetraplegia, refers to a condition where a spinal cord injury impacts the arms, hands, trunk, legs, bowel, and bladder. The most severe functional limitations arise from damage to the spinal cord in the cervical region, particularly between the first and fourth vertebrae, which can lead to paralysis of the arms, hands, trunk, and legs, and may also affect breathing. In contrast, injuries to the spinal cord at levels C5-C8 typically allow individuals to raise their arms, bend their elbows, and possibly extend their wrists.

Paraplegia

Paraplegia involves paralysis that affects all or part of the trunk, legs, and pelvic organs, while usually preserving arm and hand function. This condition commonly results from damage to the spinal cord in the thoracic (mid-back) or lumbar/sacral (lower back) regions.

Incomplete Spinal Cord Injury

An incomplete spinal cord injury occurs when only part of the cord is damaged through a tear, spinal cord compression, or other injuries. People with incomplete injuries may experience partial paralysis but may retain some feeling and voluntary movement on one or both sides of the body.

Common Types of Incomplete Spinal Cord Injuries:

  1. Anterior Cord Syndrome
This injury affects the front portion of the spinal cord, often causing paralysis and sensory loss below the level of the injury (neurological level). It typically has the poorest prognosis among incomplete injuries and closely resembles a complete injury in its severity.

  2.
  3. Central Cord Syndrome
This injury impacts the central portion of the spinal cord, leading to motor control loss, sensory deficits, and bladder dysfunction. Functional loss is often greater in the arms and hands than in the legs. While the prognosis is generally favorable, full recovery is rare. Recovery of leg function is significantly more likely than recovery of arm function.

  4.
  5. Brown-Séquard Syndrome
This injury occurs on either the left or right side of the spinal cord. On the same side as the injury, individuals may experience weakness, paralysis, or loss of proprioception (sense of body position). On the opposite side, sensory deficits such as pain and temperature sensitivity are common. This syndrome has the best prognosis for full recovery among incomplete injuries.

  6.
  7. Cauda Equina Syndrome (CES) and Conus Medullaris Syndrome (CMS)

    • CES involves spinal compression of nerve roots in the lumbar region, causing muscle weakness and sensory deficits, but it may not significantly affect movement.
  8.
    • CMS affects the sacral cord and lumbar nerve roots, presenting similar symptoms, including weakness and sensory loss. Both conditions require urgent medical attention to prevent long-term complications.
  9.
  10. Posterior Cord Syndrome
This injury affects the back portion of the spinal cord, leading to poor coordination and impaired motor skills. Recovery potential depends on the severity of the neurological deficits.

Complete Spinal Cord Injuries:

Complete injuries result in total paralysis and loss of sensory communication below the injury site. These injuries are further categorized based on the affected areas:

  • Paraplegia: Complete paralysis of the lower body, including the legs, caused by injury to the lower spinal cord.
  •
  • Tetraplegia (Quadriplegia): Complete paralysis of the body below the neck, including the arms, hands, torso, and legs, resulting from injuries to the cervical spinal cord.

What is the Time limit to File a Spinal Cord Injury Lawsuit in Ontario?

In Ontario, the time limit to file a spinal cord injury lawsuit is generally two years from the date of the injury. This is in accordance with the Limitations Act, 2002. However, there are exceptions to this rule

Discovery Rule

If the injury or its connection to the accident was not immediately apparent, the two-year limitation period begins when the injury is reasonably discovered.

Claims Involving Minors

If the injured person is a minor, the limitation period typically does not begin until they turn 18, unless a litigation guardian is appointed.

Cases Against Municipalities or Public Entities

If the injury involves a claim against a municipality (e.g., due to unsafe road conditions), written notice must generally be provided within 10 days of the incident, though exceptions may apply in certain circumstances.

Your Future Is Worth Fighting For

We know every injury is personal. Behind every injury is a story of loss or a change that can be a career put on hold; a family thrown into financial distress; dashed dreams. Trial Experience Matters.

Knowing the importance of trial experience is important. Many personal injury lawyers imply that they have it when they don’t. They may state that they “appear” at various court levels, but that doesn’t mean they went to trial. They may say they “fight” or that they are “tough,” but if they have never gone to trial for their clients in the past, what exactly did they fight, and just how tough are they?

We invite you to review our trial report card for further review.

Frequently Asked Questions

How can a personal injury lawyer help me?
An accident can lead to lifelong consequences for those involved. If you’ve suffered serious injuries due to someone else’s negligence, you may feel overwhelmed by emotional trauma, medical bills, securing treatment, and navigating insurance claims. Additionally, you likely want to regain the position you were in before the accident. This is why hiring a personal injury lawyer is essential—they can guide you through the process and help protect your rights.

  • Have legal publications recognized your firm as a Top 10 Personal Injury Law Firm in Canada?
  • Have you published extensively in the field of personal injury?

If you or a loved one has suffered a serious injury due to someone else’s negligence, you may be able to advance a claim for personal injury. The facts and circumstances of each case are unique, as well as the legal elements required to be satisfied. Consulting an experienced personal injury lawyer to discuss your case and provide advice on whether you have a case is the next step.

If your LTD claim has been denied, a disability lawyer can help by:

  • Sending your relevant medical information to your insurance company.
  • Ensuring you meet all timelines set out in your insurance policy.
  • Working with the doctors who are treating you (and other expert doctors, if necessary), to obtain the proper documentation needed to address to the specific provisions of your insurance policy. This is particularly important because often the forms sent to you by your insurance company can be very biased. Knowing what the right questions are to ask your doctor can often be the difference between having your claim approved, rather than denied.
  • Moving your case toward resolution through the settlement negotiations or, if necessary, the legal process.

Don’t speak to the adjuster from the insurance company.

When you consult with us, we will advise you as to your rights and options and we will help you understand your insurance policy and its terms. You may have different options available to you such as suing the other driver or you may be eligible for income replacement benefits and short-term disability.

we don’t require much information at our initial consultation, other than your memory of when, where, and how the accident happened; what injuries you’ve sustained and how it’s affected you.

Each personal injury case is unique, which is what constitutes the long durations until a settlement is achieved. Several factors go towards determining a fair value for your case. That includes, but is not limited to, the severity of the injury, the medication and treatment required for recovery, physical and mental therapy for further rehabilitation, compensation for pain and suffering, expenses required to maintain a living across a period when you are unable to return to regular activities, etc

The most important thing to do after an incident resulting in a personal injury is to focus on recovery. The next step is to start doing research for a personal injury lawyer that is right for you. Look for information regarding their qualifications, experience, and reputation among their peers.

Also consider these critical steps after an injury after seeking medical help.

  1. Report the Incident: Notify relevant authorities (police, workplace, property owner).
  2. Document Evidence: Take photos, gather witness info, and keep medical records.
  3. Track Expenses: Save all receipts related to medical care and other costs.
  4. Avoid Discussing the Case: Don’t post on social media or discuss details with others.
  5. Consult a Lawyer: Seek legal advice to understand your rights and options.

In most cases, you have 2 two years from the date of the incident to file a lawsuit. This is called the limitation period. If you were injured while you were a minor, you have two years from the date you turn 18 to file a lawsuit or two years from the date a litigation guardian is appointed on behalf of the minor. In certain circumstances, this general limitation period of 2 two years from the date of the incident does not apply. The period may be longer, or it may be shorter. For this reason, it is important to contact a personal injury lawyer as soon as possible to start the process of filing your lawsuit.
